DSS has
just filed emergency regulations to require fingerprint CLEARANCES prior
to employment. Effective July 16th
-
All required
staff must be fingerprint cleared prior to employment
(not just submitted prints);
-
The department
will have authority to remove staff from the facility based on
non-clearance;
-
For any staff
with a clearance, if a subsequent arrest occurs, the individual must
report via phone call to the department within 48 hours;
-
The criteria
for approving exemption requests will be more restrictive. For
example,
-
an exemption
will not be granted if the individual failed to disclose criminal
history;
-
violent felony
convictions will not be granted;
-
probation
and/or parole must be complete prior to receiving an exemption;
-
fewer
convictions will qualify for an exemption.
All licensees will
soon receive a letter from the department to notify you of this
regulation package. The regulations are not yet available for review.
CALA will review the regs as soon as they're available and will
participate in the public hearing process.
In the meantime, be
sure to sign up for electronic notification of clearance from the
Department of Justice. This way you'll be much more likely to get
notified of a clearance within three days (see below).
Please call Heather Harrison (916-448-1900) if you have any questions.
